As prosecutor Börge Klepping admitted when asked by Berlin weekly Junge Freiheit, the man is said to have sexually abused an eleven-year-old girl on June 20. For this he was held in custody until July 3. His lawyer then filed an application for the detainee to be released which was successful, suggesting the Dortmund public prosecutor’s office is largely responsible for the second rape.
According to prosecutor Klepping, the reasons for this were, on the one hand, that the migrant provided authorities with proof of permanent residence and therefore there was no risk of escape. On the other hand, there was allegedly “no risk of repetition”, since the suspect had previously only appeared for physical injury and drug-related offenses.
According to Klepping, it is “almost always a discretionary decision whether a suspect remains in custody” or is released. The discretionary decision was taken by Börge who vouched for Zubyr S.
But that was obviously a grave mistake: Last Friday, the 23-year-old, who had been granted temporary right of residence, lured a 13-year-old girl from a nearby playground into a hallway nearby and raped her there. The prosecutor has now accused the migrant of serious sexual abuse in the second case.
Since the young girl was able to describe the perpetrator, the Afghan was arrested the next day and is now in custody.
