The jury in Dallas had previously given the mother sole custody. She claimed that seven-year-old James Younger was born in the wrong body and wants to become a girl. The portal LifeSiteNews had reported on the case initially.
The father had sued against it and insisted on sole custody. Not only did the jury approve the medical decision-making authority in an 11: 1 decision, but the father was also ordered to call his son “Luna” on visits.
But the father says the child acts like a normal boy around him, and asked the court to be the sole decision-maker. He also launched a website in which he pleaded for help to save his child, although the website is no longer live.
While the mother wanted to start treatment for the boy with puberty-inhibiting drugs and a chemical castration, the father, Jeffrey Younger, had opted to wait in deciding on a sex change.
After the verdict, a wave of outrage was unleashed on social networks. As a result, even the State Governor of texas, Greg Abbott, had announced that he would be investigating the case.
The case has become a political issue after Younger received some $139 000 in donations, and allowed media to interview him and his son.
US Senator Rand Paul of Kentucky wrote on Twitter that children under the age of 21 are not allowed to drink alcohol and many people want to raise the age of legal smoking from 21 to 21. “But we will allow a 7 year old to have his life and body altered like this?”

US Senator Ted Cruz, a Republican, tweeted in response to the jury’s Monday decision to grant the mother, Anne Georgulas sole custody: “A 7-year-old child doesn’t have the maturity to make profound decisions like this. The state of Texas should protect this child’s right to choose — as an informed, mature person — and not be used as a pawn in a left-wing political agenda.”
The Texas Attorney General’s Office and the Texas Department of Family and Protective Services will also be looking into the case.
In 2018, Georgulas filed a lawsuit to force Younger to affirm that the boy would called by a girl’s name inside as well as outside the home. Judge Kim Cooks ultimately denied the request, saying on Friday that “the Court finds that the State of Texas has no compelling interest to justify such interference.”
Georgulas has since admitted in court that she is not actually the biological mother of the boy and used in-vitro fertilization via an egg donor.
Since kindergarten, Georgulas has enrolled James in school as a girl. She began telling him he was a girl when he was just three years old, and testified in court that she began to believe that when he liked a McDonald’s toy which was meant for girls.
